Agreeing to these terms

By using capiandbara.com, joining a waitlist or placing an order, you agree to what's on this page. If you don't, please don't use the site.

The waitlist is not an order

Joining a waitlist tells us you're interested. It doesn't reserve a plush, doesn't charge you anything, and doesn't oblige either of us to anything. Prices and dates shown before launch are our current intention, not a promise, and may change.

Orders

Plushies are bought on Amazon, so that order is between you and Amazon. What you order from us directly — personalized videos and factory supports, paid with PayPal — becomes a contract once we confirm it by email. Until then we may decline it, for example if we can't make what you asked for or we spot an obvious pricing mistake. If we do, you get a full refund and an apology.

We try hard to keep prices and descriptions accurate. If something is listed at a clearly wrong price, we're not obliged to sell it at that price.

Prices are in US dollars. Plushies are sold through Amazon, under Amazon's conditions of sale; see our shipping page. Purchases in the app are charged by Apple or Google.

Supporting the plush factory

A factory support is a purchase of the rewards listed with it (such as a name on the founders' wall, a wallpaper or a video), not a donation, and not a pre-order of a plush. Every reward is delivered whether or not the factory goal is reached. The money goes to building the plush factory; if we don't reach that goal, we'll use it to create other Capi & Bara products.

Returns

We don't accept change-of-mind returns, and we do cover orders that arrive damaged or wrong. The details are on the returns page, which forms part of these terms.

Personalized videos

When you request a video, you're asking us to create something for you, and you agree that:

• you give us permission to use what you send — the idea and any photo — for the single purpose of making that video for you;
• any photo you attach is yours to send: you either took it or have permission, and anyone recognisable in it is happy to appear;
• we won't publish your photo anywhere, or use it in our own marketing, unless you tell us separately that we can;
• the content you send is yours to send, and isn't hateful, harassing, sexual, defamatory or illegal;
• we may decline any request, for any reason, and refund it. Some things we're just not going to say, even as capybaras;
• the video is for personal use. Using it in advertising or reselling it needs our written permission first.

A 20-second video is $70 and a 40-second video is $99. We aim to deliver within 1–3 days of accepting your request.

Our characters and artwork

Capi & Bara, The Peep Club, the characters, their names, the artwork, the photography and everything else on this site belong to us.

Share our posts, repost them, make your friends look at them — please do. What you can't do is sell merchandise using our characters, pass our artwork off as your own, or use any of it commercially without asking. Fan art made for love, not money, is always welcome.

Using the site

Don't try to break the site, scrape it, or use it to send spam through our forms. We may block access if you do.

No promises about availability

We'll keep the site up and accurate as best we can, but we can't promise it will never go down or never contain a mistake.

Liability

We're responsible for the things a seller should be responsible for: getting you what you ordered, in good condition. We're not liable for indirect or consequential losses. Nothing here limits liability that can't legally be limited — including for death, personal injury or fraud.

Which law applies

⚠️ To complete before launch: the country whose law governs these terms. Consumers always keep the protections of their own country's law regardless.

Changes

We may update these terms. The version that applies to your order is the one published when you placed it.
